Premium Inflatables Limited – Terms of Business
1. Definitions
- "Client" refers to any individual, organisation, or company hiring equipment or services from Premium Inflatables Limited.
- "Company" refers to Premium Inflatables Limited (Company Number: 16280355).
- "Equipment" means all items provided for hire, including but not limited to bouncy castles, inflatable slides, action games, soft play, ball pools, and accessories.
- "Hire Period" means the agreed duration for which the Equipment is hired.
- "Booking Form" means the online, written, or telephone record confirming the hire details.
- "Dry Hire" means Equipment is hired without a Company supervisor; Client is responsible for operation and supervision.
- "Wet Hire" means Equipment is hired with a Company supervisor present.
2. Bookings & Contract
- All Equipment remains the property of the Company at all times.
- By placing a booking, whether verbally, electronically, or in writing, the Client agrees to be bound by these Terms of Business.
- Bookings are only confirmed upon receipt of a booking confirmation and (where required) a non-refundable booking fee.
- The Company reserves the right to refuse any booking at its absolute discretion.
3. Payment Terms
- The balance of invoice payments by BACS is due no less than fourteen (14) days prior to the Hire Period start, unless otherwise agreed in writing.
- Failure to pay on time may result in cancellation and loss of booking fee.
- All prices are subject to VAT at the prevailing rate unless expressly stated otherwise.
- The Company reserves the right to charge interest on overdue amounts at 2% above the Bank of England base rate.
4. Cancellations & Refunds
- Cancellations must be made in writing or by telephone to the Company.
- The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 provide no right to a cooling-off period for leisure activities arranged for a specific date.
- If the Client cancels less than fourteen (14) days before the Hire Period, the full hire fee is payable.
- In the event of Force Majeure or events beyond the Company’s control (e.g., adverse weather, equipment breakdown, transport delays), the Company may cancel or modify the booking. In such cases, the Company’s liability is limited to a refund of monies paid (on a pro-rata basis if applicable).
5. Delivery, Installation & Collection
- The Company will deliver, set up, and collect Equipment at the agreed times and location.
- All timings are approximate and subject to reasonable variation.
- The Client must ensure unobstructed access to the site and inform the Company of any issues such as stairs, restricted access, or underground services.
- The Client or an authorised representative must be present to sign for Equipment upon delivery and collection.
- Once signed for, the Equipment is deemed to be in good order and fit for purpose.
- The Client is responsible for Equipment security and safe keeping during the Hire Period.
6. Use of Equipment & Supervision
- Equipment must only be used for its intended purpose and in accordance with the Company's instructions and safety guidelines (provided in writing and on-site).
- For Dry Hire, the Client must provide at least two (2) competent adult supervisors per entrance/exit of any inflatable at all times.
- No Equipment shall be moved or relocated once set up by the Company.
- No shoes, food, drink, face paints (unless Snazaroo), pets, or sharp objects are allowed on any Equipment.
- The Client must immediately cease use of any Equipment that becomes unsafe and notify the Company.
- The Company reserves the right to terminate the Hire Period without refund if Equipment is misused or safety is compromised.
7. Liability, Insurance & Indemnity
- The Company holds public liability insurance to the value of £5 million.
- The Client is responsible for arranging adequate insurance to cover participants and guests.
- The Company is not liable for any injury, loss, or damage arising from improper use or unsupervised Equipment.
- The Client indemnifies the Company for all damage or theft of Equipment during the Hire Period.
- Equipment hired on a Dry Hire basis is NOT covered by Company insurance for use or supervision.
8. Damage, Loss & Charges
- The Client is responsible for any loss, theft, or damage to Equipment (fair wear and tear excepted) and will be liable for the full repair or replacement cost plus any loss of earnings.
- The Client will not withhold Equipment or delay collection under any circumstances.
9. Health & Safety
- All Equipment will be supplied with relevant safety instructions and risk assessments upon request.
- Equipment must not be used in adverse weather (winds exceeding 24 mph, rain, etc.).
- It is the Client’s responsibility to ensure the site is free of obstructions and suitable for Equipment installation (including adequate ground anchorage for inflatables).
10. Complaints
- Any complaints must be raised with the Company as soon as possible, and in any event within 24 hours of the Hire Period.
- Complaints made after the event or after the Equipment has been removed may not be considered.
11. Data Protection & Marketing
- By making a booking, the Client consents to the processing of their data in accordance with the Company’s Privacy Policy (available on request and via our website).
- The Company reserves the right to use photographs of Equipment at events for marketing purposes unless otherwise instructed in writing.
12. Governing Law
- These Terms of Business shall be governed by and construed in accordance with the laws of England and Wales.
- Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
13. General
- The Company reserves the right to amend these Terms of Business at any time, with changes posted on the Company website and/or notified to Clients.
- No variation of these Terms shall be valid unless in writing and signed by a Director of Premium Inflatables Limited.
14. Power Supply & Electrical Requirements
- It is the responsibility of the Client and/or venue to ensure that all power supply requirements for each hired item are met in full, prior to the Hire Period.
- Typical Requirements:
- Many larger inflatables and electronic items require either:
- A dedicated 32amp power supply direct from a 100amp fuse board, within 40 metres of the setup location; or
- Two 240v 13amp outlets on two separate, dedicated 32amp ring mains direct from a primary 100amp mains fuse board, within 75 feet of the setup area.
- Items may appear to function with less power, but uninterrupted operation cannot be guaranteed unless these requirements are strictly met.
- If the required power supply is not available, the Client is responsible for arranging a suitable generator. Premium Inflatables Limited can supply generators if required—please enquire at booking.
- No Refund Policy: Electrical breakdowns or failures resulting from failure to meet the stated power requirements are not eligible for refund or compensation under any circumstances.
- Premium Inflatables Limited and its employees accept no liability for any losses or disruption caused by insufficient power supply or electrical faults resulting from non-compliance with the above requirements.
